The Minnesota Department of Health, Health Regulation Division is writing to share important news about Minnesota’s new assisted living licensure law.  We understand that as providers you have many concerns related to managing your agency’s response to COVID-19. We will send this information again in a few weeks as a reminder of changes to come. However, we felt the information was important enough to provide now, even during these challenging times.

Last year, the Minnesota Legislature passed a new law for licensing assisted living facilities. The new law will go into effect next year on August 1, 2021.  We wanted you to be aware of the changes that will happen under the law so that you can prepare.

This law will affect you if:

• You currently provide assisted living services;
• You are the “arranged home care provider” in a housing with services setting;
• You are a housing with services establishment;
• You provide customized living services under the Elderly Waiver (EW), Brain Injury (BI), or Community Access for Disability Inclusion (CADI) waiver; or
• You plan to provide assisted living services and/or customized living services in Minnesota.

If you wish to provide any of these services after August 1, 2021, you must transition to an assisted living license or you will not be able to provide or bill for these services.

We don’t have all the details for you yet, but the Legislature has directed the Minnesota Department of Health (MDH) to write rules to help put the law into action. An advisory committee that includes assisted living providers and advocacy organizations is reviewing the rules as they are written and providing feedback to the department.

If it is your intent to be a service provider after August 1, 2021, it will be important for you to stay updated on changes and requirements.
