Notice of Final Rule Adjusting Civil Monetary Penalties (CMPs) for Inflation

CMS issued a Notice of Final Rule Adjusting Civil Monetary Penalties (CMPs) for Inflation on Tuesday, January 2019. 

As noted in the above Memorandum Summary found in QSO 19-04-NH/HHA/CLIA, the new CMP amounts and ranges are effective October 11, 2018.

Final Rule – Adjustment of Civil Monetary Penalties for Inflation lists the civil monetary penalty authorities and the penalty amounts administered by all of the Department of Health and Human Services (HHS) agencies.

CMP amounts will be posted on the Survey and Certification website: Civil Monetary Penalties (Annual Adjustments).  At the time of this blog, this website does not contain the CMP amounts so keep checking back as they should be posted soon.

The last 13 pages of the 15-page QSO 19-04-NH/HHA/CLIA memorandum (hyperlink provided in the 1st paragraph of this blog) contains an Appendix A – Calculation of CMP Adjustments that provides the citation and description as well as the date of the last penalty figure or adjustment as well as the maximum adjusted penalty for 2016, 2017 and 2018.   The entities included in this Appendix are SNFs, SNFs/NFs, Clinical Laboratories (CLIA) and Home Health agencies (HHA).
