Advance Beneficiary Notice of Noncoverage (ABN), Form CMS-R-131 “Update”

CMS-R-131 is issued by providers (including independent laboratories, home health agencies, and hospices), physicians, practitioners, and suppliers to Original Medicare (fee for service – FFS) beneficiaries in situations where Medicare payment is expected to be denied. The ABN is issued in order to transfer potential financial liability to the Medicare beneficiary in certain instances.

In the left footer, you’ll note that OMB set an expiration date of 3/31/2020:


In past years, CMS posted an updated form with an updated expiration date. CMS posted this notification back on March 18, 2020.  I waited to post this blog until today, thinking that OMB will provide us with a future expiration date before March 31st but that has not happened.  Here’s what the notice says:

***The ABN, Form CMS-R-131, is currently awaiting OMB approval for renewal. CMS will provide instructions when it does get approved.  In the meantime, continue to use the current form until further instruction is provided.
